Freedom of Information

Since October 1, 2010, BC Ferries has been responding to Freedom of Information requests in accordance with legislation passed by the Province of British Columbia.  This page tells you more about the Freedom of Information and Protection of Privacy Act, and what is involved in submitting Freedom of Information requests to BC Ferries.    

What is the Freedom of Information and Protection of Privacy Act?

As the name suggests, the Freedom of Information and Protection of Privacy Act  (FOIPP Act) has two main purposes:

  1. Freedom of Information To make public bodies more open and accountable by providing the public with a legislated right of access to government records, and 

  2. Protection of Privacy To protect your right to personal privacy by prohibiting the unauthorized collection, use or disclosure of your personal information by public bodies.

How can I make a request?

The FOIPP Act is not meant to replace existing means of obtaining information. Before you make a request using the FOIPP Act, be sure you have tried searching the BC Ferries website to obtain the information. How do I make a Formal request?

If you are not able to get the information you want through the informal route, and you still wish to make a request under the FOIPP Act, you must do so in writing.  You can either fill out a form or simply make your request in the form of a letter or email. (Please note that requests for your personal information must be signed.) Once your request has been received, BC Ferries has 30 working days to provide you with a response, subject to any extensions permitted under the FOIPP Act.  If you have questions or need clarification about records held, you may wish to contact [email protected].

Is there a cost?

The FOIPP Act provides you with access to your own personal information free of charge. Access to all other information may be subject to a fee. Charges are based mainly on time spent searching and retrieving records, however, the FOIPP Act provides that the first three hours of search and retrieval time is free of charge. Each additional hour is charged at the rate prescribed in the regulations to the FOIPP Act. Charges also apply to photocopies and printed material.

It is helpful if you describe the records you want as well as you can, and limit your request to only the records you need.  The more general or complex your request is, the longer it will take to process, and the greater the fees that may apply.

What records can I request?

The FOIPP Act applies to all records in the custody and/or under the control of BC Ferries, including personal information.  “Personal information” means recorded information about an identifiable individual other than work contact information. Examples of personal information include an individual’s name, address or telephone number. Note: Requests for information regarding a person other than yourself must be accompanied with the other person's signed consent or your proof of authority to act on that person's behalf.

Can I keep up to date on requests made by others?

Yes.  BC Ferries will send email notifications to those interested when records (except personal information) are made available to a requestor through the Freedom of Information process.

In addition, BC Ferries posts all information (except personal information) released to a requestor on its website.  Responses are moved to BC Ferries' request archive page one year after file is closed.
